Group One winner Lord Shanakill is trained by Burke
|
Lawyers representing Karl Burke say the trainer plans to appeal against his 12-month British Horseracing Authority ban for alleged race-fixing.
He was banned after an inquiry into a 2007 court case, during which he was arrested but released without charge.
The BHA fined and banned two jockeys involved in the case for admitting passing on insider information.
Burke's lawyers say his punishment was disproportionate with his breach of the rules and those given to the jockeys.
The Yorkshire-based handler was investigated after the BHA finished its review into the Old Bailey trial in 2007, when jockeys Darren Williams, Fergal Lynch and Kieren Fallon were all cleared of wrongdoing.
The trio of jockeys had faced charges regarding their relationships with owner Miles Rodgers and whether they gave him inside information over 12 races in 2004.
Burke was arrested but released without charge as part of the initial police inquiry.
As a result of the BHA's investigation, Rodgers has been warned off for life and Williams, currently based in the United States, has agreed not to apply for a British licence for 12 months as well as pay a £50,000 fine.
The BHA panel said it "felt driven to conclude that it was necessary to impose a disqualification on Burke, and that the proper period was 12 months, bringing into account the various features of this case."
But a statement from Burke's lawyers, who said their client accepted he had been "misguided" in his dealing with Rodgers, said they felt their client had been unfairly treated.
"The severity of Mr Burke's penalty is out of proportion with his breach of the rules and the penalties imposed on Mr Lynch and Mr Williams," it said.
"The disparity in these penalties is not justified.
"Unlike Fergal Lynch and Darren Williams, Mr Burke has not been offered the penalty of a fine in place of his disqualification.
"This penalty not only affects Mr Burke personally but also his owners, employees, and others connected with his stables in whose interests he has worked diligently without any other reproach to his training."
"Mr Burke has been treated most harshly receiving 12 months disqualification even though in effect he provided inside information in a manner no graver than Mr Williams.
"It is clear from these proceedings that he has not been treated by the BHA comparably with Mr Lynch and Mr Williams nor fairly when all matters of the proceedings are considered. He intends to appeal this decision."
Burke had been enjoying a fine season and recently saddled Lord Shanakill to Group One success in France.
